Conference on Postcontractual Liability at IE University

Foto Bertolini 1Andrea Bertolini, a Fellow in Private Law at the Scuola Superiore St. Anna in Pisa, delivered today a conference in the Segovia campus of IE University under the title “Postcontractual Obligations and Liability.” 

In the conference, Dr. Bertolini explained his theory on this topic. He proposed to address all the different types of duties and obligations existing after the contract has been performed or terminated in a unified manner, based on the idea of good faith. And he did so with a truly European perspective, which allows the theory to apply in the main European jurisdictions without the need to resort to statutory intervention.

Dr. Bertolini was introduced by Dr. Marco de Benito, Professor of Law at IE University. Dr. Francisco de Elizalde, also Professor of Law at IE University, acted as discussant. 

The conference was held under the auspices of the European Module “Towards a Common Private Law of Europe,” an IE University undertaking within the prestigious Jean Monnet Programme of the European Commission. Headed by Dr. Marco de Benito, the Module aims at helping students, scholars, and lawyers develop a more global and comparative understanding of the law.

Andrea Bertolini, Fellow de Derecho Privado en la Scuola Superiore St. Anna, en Pisa, dio hoy una conferencia en el campus de Segovia de IE University con el título “Postcontractual Obligations and Liability.”

Foto Bertolini 2En la conferencia, el Dr. Bertolini expuso su teoría sobre el tema, que propone tratar unitariamente, sobre la base de la buena fe, los diferentes tipos de deberes y obligaciones que surgen o permanecen vigentes una vez el contrato se ha extinguido por cumplimiento, resolución o cualquier otra razón. La teoría del Dr. Bertolini adopta una perspectiva genuinamente europea, que le permite aplicarse en los principales países europeos sin necesidad de acudir a intervención legislativa alguna.

El ponente fue presentado por Marco de Benito, y Francisco de Elizalde fungió como discussant. Tanto Marco de Benito como Francisco de Elizalde son Profesores en IE University.

La conferencia tuvo lugar en el marco del Módulo Europeo “Hacia un Derecho privado común para Europa”, un proyecto de IE University dentro del prestigioso Programa Jean Monnet de la Comisión Europea. Dirigido por el Profesor Marco de Benito, el objetivo del Módulo es contribuir a una visión del Derecho más global y comparada, no sólo entre los alumnos sino en la comunidad jurídica, académica y profesional.
